Foreword for Clerks
Although the views of some people are that local councils are a special case when it comes to employment law, almost without exception they are subject to exactly the same employment law provisions as any other organisation.
And employment law is extensive, complex and ever changing. Not only does the UK government have a steady programme of developing and enhancing employment law, it also has to take note of European Union requirements.
Unfortunately some local councils seem to have a problem addressing employment law issues and there appear to be numerous occasions when conflict arises between the council itself and the clerk or other members of staff.
Good practice and procedures help prevent these problems and the clerk, as the “chief executive” is in the role of addressing these, sometimes in his/her own role as employee.
Advice and guidance can be found in many places, however with practical experience in local government, commerce, a charity and in local councils this website has been compiled with the sector in mind.
Often local councils will seek advice from their principal council, however when push comes to shove a local council is an independent corporate body and must stand by its own decisions and actions.
